Paramount+ Gift Card Terms

These Paramount+ Gift Card terms (“Terms”) apply to the purchase and use of Paramount+ Gift Cards issued by Paramount Streaming Services Inc., a Delaware corporation (“Paramount,” “us,” or “we”), and form an agreement between you (the purchaser or holder of a Gift Card) (“you”), and Paramount.
These Terms incorporate by reference the following provisions in our Terms of Use available at https://pplus.legal/tou: “Dispute Resolution; Arbitration Agreement” and “Governing Law, Venue, and Jurisdiction”; and the following provisions in our Subscription Terms available at https://pplus.legal/subscription: “Cancellation” and “Unpaid Amounts”.
YOU AGREE TO THE DISPUTE RESOLUTION PROCEDURE AND ARBITRATION AGREEMENT DESCRIBED IN SECTION 1 OF OUR TERMS OF USE AVAILABLE AT https://pplus.legal/tou. PLEASE NOTE THAT ANY DISPUTE BETWEEN YOU AND US, EXCEPT FOR SMALL CLAIMS, IS SUBJECT TO BINDING ARBITRATION AND CLASS ACTION WAIVER.
As used in these Terms, “Gift Card” means a prepaid stored-value payment method with a fixed monetary value attached to a unique code provided in physical or electronic form in a specific currency redeemable on Paramount+ (the “Service”) only via www.paramountplus.com (the “Website”) in accordance with the terms below.
By purchasing, accepting or using your Gift Card, you agree to be bound by these Terms and acknowledge our Privacy Policy available at https://pplus.legal/privacy. If you do not agree with these Terms, do not purchase, use or accept the Gift Card.
1. GIFT CARD ISSUANCE
1.1 Gift Cards may only be purchased from an authorized retailer or partner (either online or in-store). Visit www.paramountplus.com/gift-card for a list of authorized retailers that sell Gift Cards. Your purchase of Gift Cards from authorized retailers and partners may be subject to additional terms and conditions of such retailers and partners. In the event of a conflict between these Terms and the terms and conditions of an authorized retailer or partner, these Terms shall prevail.
1.2 Gift Cards are assigned a fixed monetary value and can only be applied as a credit to a Paramount+ account (an “Account”) in the currency denominated on the Gift Card to be used towards the purchase of a Subscription (as defined below) on the Service in the 50 states of the United States as well as the District of Columbia, and the U.S. Territories of American Samoa, Guam, the U.S. Virgin Islands, the U.S. Minor Outlying Islands, and the North Mariana Islands (collectively, the “Territory”). Unless otherwise specified, unredeemed Gift Cards do not expire and are not subject to fees.
1.3 Do not share a Gift Card PIN number or other Gift Card code with anyone except the intended recipient. Upon delivery or electronic transmission of the Gift Card to you or your designated recipient, the risk of loss and title for the Gift Card passes to you.
2. USING YOUR GIFT CARD
2.1 You must have an Account to redeem a Gift Card. You can create an Account at any time. You must be 18 years of age or older, and a resident of the Territory, to create an Account and to sign-up for a Subscription (as defined below).
2.2 On redemption, the total value of your Gift Card will be applied as a credit to your Account and in these Terms, any such credit in your Account will be referred to as “Gift Card Credit”. Gift Card Credit can be used against the cost of different types of subscriptions on or via the Service (each a “Subscription”)). Gift Card Credit may also be applied against the cost of a pre-existing Subscription if that Subscription was purchased on the Website.
2.3 To redeem a Gift Card, go to www.paramountplus.com/redeem, or if you have an active Subscription purchased on the Website, you can also redeem a Gift Card in your Account. If you do not have an active Subscription, only one Gift Card may be redeemed when you first purchase a Subscription. Additional Gift Cards may be redeemed subsequently through your Account and will be applied in accordance with the provisions set out in Section 2.3(b) below.
(a) If you do not have an active Subscription and you redeem a Gift Card, you will be asked to select a Subscription for purchase at the time of redemption. Your Gift Card Credit will be automatically used towards the cost of your selected Subscription (plus applicable taxes); and, in the case of recurring Subscriptions, to cover the cost of that Subscription on each recurring billing period thereafter until your Subscription is cancelled or there is insufficient Gift Card Credit remaining to cover all applicable costs on renewal, following which the provisions of Section 3 will apply. Please note that any Subscription purchased simultaneously with the redemption of a Gift Card will not be eligible for a free trial and/or promotional offer.
(b) If you have an active recurring Subscription purchased on the Website and at any time following that purchase you redeem a Gift Card, your Gift Card Credit will be automatically used towards the cost of this Subscription (plus applicable taxes) on your next renewal date and towards the cost of each renewal thereafter until your Subscription is cancelled or there is insufficient Gift Card Credit remaining to cover all applicable costs on renewal, following which the provisions of Section 3 will apply. Please note that if your Subscription is subject to a limited free trial or a promotional offer that covers its full cost for a limited time, redeeming a Gift Card during the free trial or promotional offer period, will not affect the validity of that free trial or promotional offer and the Gift Card Credit in your Account will be automatically applied towards any renewal after such free trial or promotional period ends (unless you cancel the relevant Subscription before payment is first due).
2.4 If you change your Subscription by switching plans, this may change the rate or frequency at which your Gift Card Credit is used.
2.5 Gift Cards cannot be used to purchase Subscriptions sold by an app store (for example, Apple or Google) or by any of our other third-party partners. If you wish to use a Gift Card and previously purchased your Subscription through one of our third-party partners, please visit our Help Center at https://paramountplus.com/help/giftcards for more information.
3. INSUFFICIENT GIFT CARD CREDIT IN ACCOUNT
3.1 If you have a recurring Subscription purchased on the Website and at the time of renewal, the Gift Card Credit in your Account is too low to cover the cost of that Subscription (plus applicable taxes) in full, the following will apply:
(a) If you have another payment method associated with your Account, then we will first apply the remaining Gift Card Credit to the cost of that Subscription (and any applicable taxes) and the payment method associated with your Account will be charged the remaining cost of your Subscription. By agreeing to these Terms, you authorize us to charge the payment method associated with your Account for the balance due and for each recurring billing period thereafter until you cancel, subject to our Subscription Terms available at https://pplus.legal/subscription.
(b) If you do not have a payment method associated with your Account, your Subscription will not be renewed and it will automatically terminate unless you redeem a new Gift Card or add a valid payment method to your Account before termination takes effect.
4. CANCELLATION OF SUBSCRIPTION AND REMAINING GIFT CARD CREDIT
4.1 If you redeem a Gift Card and subsequently terminate your Subscription, any Gift Card Credit will remain on your Account indefinitely, or until such time as you sign-up for a new Subscription on the Website or your Account is deleted.
(a) If you sign-up for a new Subscription and provide your payment details on sign-up, the Gift Card Credit remaining in your Account will be automatically applied first towards the cost of that Subscription in the following manner:
- (i) at the start of that Subscription (or at the end of any applicable promotional offer period that covers its full cost for a limited time unless you have cancelled your Subscription before the end of that promotional offer period);
- (ii) at the start of each billing period, if you have signed up for a recurring Subscription, until such time as your Gift Card Credit is depleted; and
- (iii) if at any time, there is insufficient Gift Card Credit remaining to cover all applicable costs on initial sign-up or on renewal, the payment method associated with your Account will be charged and the provisions of Section 3.1(a) will apply.
(b) If you sign-up for a new Subscription and simultaneously redeem an additional Gift Card, your previous Gift Card Credit and the additional Gift Card Credit redeemed will be combined and automatically applied first towards the cost of that new Subscription in the following manner:
- (i) at the start of that Subscription (or at the end of any applicable promotional offer period that covers its full cost for a limited time unless you have cancelled your Subscription before the end of that promotional offer period);
- (ii) at the start of each billing period, if you have signed up for a recurring Subscription, until such time as your Gift Card Credit is depleted; and
- (iii) if at any time, there is insufficient Gift Card Credit remaining to cover all applicable costs on initial sign-up or on renewal, any payment method previously provided with respect to any prior subscription purchased on our Website will be charged or any payment method added to your Account following the purchase of this new Subscription will be charged, and the provisions of Section 3.1(a) will apply.
4.2 If your Account is deleted (including upon your request), the provisions in Section 8.3 will apply.
5. VIEWING YOUR GIFT CARD CREDIT
5.1 While your Subscription is active, you can view your Gift Card Credit in your Account.
5.2 If your Subscription terminates, you will not be able to view the remaining balance in your Account, so be sure to make a note of it before your Subscription ends. You can also contact our Customer Support team at any time for details of the Gift Card Credit remaining in your Account. Just click on the speech bubble icon in the bottom right-hand corner of our Help Center (https://help.paramountplus.com) and type "Agent".
6. NO CASH REDEMPTION OR RESALE
6.1 Gift Cards have no cash value and are not redeemable for cash, either prior to or subsequent to redemption, except as required by applicable law.
6.2 Once redeemed, Gift Card Credit may not be withdrawn from the Account nor transferred or assigned to another person or Account.
6.3 You may not resell Gift Cards without our express written authorization.
6.4 A Gift Card is not valid and will not be honored by us, and we will not be liable for the value of the Gift Card if it is obtained from an unauthorized seller or reseller and/or redeemed by, or used in conjunction with an Account of, a person who is not a resident in the Territory.
7. NO FEES
There are no additional fees for using a Gift Card, but if you have insufficient Gift Card Credit to meet the cost of your Subscription, you will lose access to the Service at the end of your current billing period unless you redeem a further Gift Card or add a payment method to your Account as described in Section 3.1(b) above to cover the remaining cost of that Subscription.
8. REFUNDS AND CANCELLATION
8.1 Gift Cards are not refundable and cannot be used to purchase other Gift Cards. You may not reload, resell, or otherwise transfer for value any Gift Card.
8.2 Notwithstanding the provisions in Section 8.1, if a Gift Card is redeemed and the Gift Card Credit is used to purchase a Subscription, such Subscription will be subject to the cancellation provisions set out in our Subscription Terms available at https://pplus.legal/subscription. If you purchased a Subscription using Gift Card Credit and this Subscription is cancelled, and Paramount determines you are eligible for a refund, in its sole discretion, such refund will be issued to your Account in the form of Gift Card Credit.
8.3 If your Account is deleted (including upon your request), you acknowledge that you will forfeit the remaining balance of any Gift Card Credit. For the avoidance of doubt, you can always cancel your Subscription without deleting your Account and in doing so, your Gift Card Credit will remain in your Account to be used in accordance with the provisions set out in Section 4 above.
9. INTELLECTUAL PROPERTY
Gift Cards may not be used in connection with any marketing, advertising or other promotional activities without our prior written approval. Use of the Paramount+ name, any Paramount+ logo, the Paramount logo, or the logos of any other company within the same group as Paramount (an “Affiliate”), and any of their trade dress or trademarks in connection with the purchase and/or use of a Gift Card is strictly prohibited. Furthermore, the use of Gift Cards in any manner that states or implies that any person, website, business, product or service is endorsed or sponsored by, or is otherwise affiliated with, the Service, Paramount or any Affiliate is prohibited without our prior written approval.
10. LOST OR DAMAGED CARDS; FRAUD
10.1 We are not responsible for any Gift Card that is lost, stolen, destroyed or used without your permission.
10.2 Gift Cards are subject to verification, and any Gift Card that we believe in our sole discretion to have been purchased, obtained, or redeemed fraudulently or through illegal means will be subject to invalidation without refund, including any Gift Card Credit applied to an Account following its redemption or debited towards a Subscription.
11. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
PARAMOUNT AND ITS AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND WHETHER EXPRESS OR IMPLIED OR STATUTORY, WITH RESPECT TO THE GIFT CARDS OR GIFT CARD CREDIT, INCLUDING BUT NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY, AND IMPLIED WARRANTIES OF OR FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, COMPATIBILITY, SATISFACTORY QUALITY, AND NON-INFRINGEMENT.
TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW, IN NO EVENT SHALL PARAMOUNT OR ITS AFFILIATES BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM THE PURCHASE, REDEMPTION OR USE OF A GIFT CARD, HOWEVER CAUSED. NOR SHALL PARAMOUNT BE HELD LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND ITS REASONABLE CONTROL.
NOTWITHSTANDING THE FOREGOING, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE AND EXCLUSIVE REMEDY, AND OUR SOLE AND EXCLUSIVE LIABILITY, WILL BE LIMITED TO APPLYING THE TOTAL VALUE OF SUCH GIFT CARD AS GIFT CARD CREDIT TO YOUR PARAMOUNT+ ACCOUNT. SOME JURISIDCTIONS DO NOT ALLOW FOR THE DISCLAIMER OF CERTAIN WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, THE EXCLUSIONS APPLY AND LIABILITY IS LIMITED ONLY TO THE EXTENT PERMITTED BY LAW.
12. MODIFICATION OF TERMS
We may modify these Terms, our Terms of Use, Subscription Terms, and Privacy Policy at any time, with or without notice, even though these changes may affect your ability to use a Gift Card, subject to our compliance with applicable laws. The most current version of these Terms will be made available at https://pplus.legal/giftterms and will supersede all previous versions.
13. MISCELLANEOUS
Notwithstanding anything in these Terms to the contrary, if any part of these Terms are deemed invalid or inapplicable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal and enforceable. If such provision cannot be so modified or restricted, it shall be excised from these Terms without affecting the validity, legality or enforceability of the remainder of these Terms, which shall be fully enforced.
